Court Details & Timeline

Following the arrest, most want the matter to go away quickly. That’s not how the court process works. The time of arrest to court disposition can last from 6 months to 2 years depending on the size of the county arrested in (county of origin) and their speed of court processing. (The bigger the county, the slower the process). Also, if you arrested outside your county of residence, you will have to travel to the county of origin for all court matters, or as advised by your attorney.

Following arrest, bail is needed to be released from jail prior to the court disposition. Common arrests may have a bail associated with the offense, although many felonies require a judge to set the bail amount. Keep this in mind because depending on the time/day of the arrest, it could be several days before it's arranged in court for your loved one to be released.

A bail is paid by family member or bail bondsman. Bail is used to ensure that the offender of the alleged criminal act will report accordingly to all court processes and the money is returned upon doing so. If a bail bondsman is utilized, then the money/percentage of bail paid to the bondsman is not returned.

As seen in the attached picture, sentencing guidelines are towards the middle of the journey, not at the beginning. Therefore many services and state resources are not available until after disposition and these guidlelines. Think of disposition as the final decision for the offense which will detail the court obligations or “conditions” to successfully fulfill the judicial agreement or “judgment” with the court. Many common responsibilities are associated with offenses such as jail time, supervision, recovery classes, behavior courses and community service.

*When drugs and/or alcohol are involved, it’s not uncommon to see additional arrests prior to sentencing.

Court requirements can vary from county, state, federal and/or judicial. A good example of this is DWI requirements, which have many state regulations and laws that cannot be altered.

Until court conditions and the time requirement is fulfilled, the defendant will remain on supervision with the court and county of origin. Any new arrests or violations of conditions can result with incarceration periods and modified conditions or sanctions.
